Acceptance of Terms
These terms of service ("Terms") govern your use of Imagena ("the Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
Service Description
The Service uses AI to generate outfit and portrait images from the photos you upload. Results are produced by AI models; quality and accuracy may vary, and we make no guarantees about any specific result. The Service is for personal, lawful use only.
Eligibility and Account
You must be of the legal age to form a binding contract in your jurisdiction to use the Service. You are responsible for the information you provide, for activity under your account, and for the security of your credentials.
Acceptable Use
You agree not to:
- Upload images of other people without their consent.
- Upload or generate illegal, infringing, hateful, or otherwise harmful content.
- Upload or generate any explicit sexual content, NSFW (Not Safe For Work) content, pornographic, adult, nude, or sexually suggestive content.
- Attempt to bypass content moderation, or request generation of content that violates our acceptable use policy.
- Infringe on any third party's intellectual property, privacy, or publicity rights.
- Reverse engineer, abuse, overload, or attempt to disrupt the Service.
- Resell or commercially exploit the Service without our permission.
User Content and License
- You retain ownership of the images you upload.
- You grant us a limited license to process your content and transmit it to our AI providers solely to operate the Service and deliver the results.
- You represent that you have the rights needed to upload the content and grant this license.
Intellectual Property
The Service, including its software, design, and branding, is owned by us and protected by applicable law. Except as required to use the Service, these Terms grant you no rights in our intellectual property.
Credits and Payment
- The Service offers a free plan with daily credits, plus paid Pro and Ultimate subscription plans (billed monthly or yearly) and optional one-time credit packs.
- Plan features, prices, and credit amounts may change. We will give you reasonable advance notice of any material change to your current paid plan.
- Any future paid terms will be presented to you before you are charged, and you authorize us to charge your selected payment method for the displayed amount.
Refund Policy
Because Imagena delivers a digital service that is consumed immediately after payment, all fees are generally non-refundable once the service has been used. The following exceptions apply:
- New subscriber 7-day guarantee — If this is your first paid subscription and you request a refund within 7 days of your initial charge, we will refund the full amount, provided your usage of plan credits has not exceeded 20% of the monthly quota.
- Duplicate charge — Any duplicate or other billing error made by us will be refunded in full.
- Verified service outage (≥ 72 hrs) — For an extended, verified service outage within our control, we will issue a pro-rated credit or refund for the affected period.
- Credit packs not yet used — One-time credit packs that have not been partially or fully consumed may be eligible for a refund within 7 days of purchase, at our sole discretion.
- Statutory rights — If applicable law grants you a withdrawal or refund right (for example, a 14-day right of withdrawal in the EU/UK for consumers), that right is preserved and is not limited by this policy.
Non-refundable items include: fees for a subscription period that has already been used; subscription fees requested more than 30 days after the initial purchase of an annual plan; one-time credit packs that have been partially or fully used; and accounts terminated for violation of these Terms or the Acceptable Use Policy. To request a refund, contact us at taozhi10100@gmail.com from the email address registered on your account and include your account email, transaction ID, and the reason for the request. We will acknowledge refund requests within 2 business days and process eligible refunds within 5–10 business days. Refunds are issued to the original payment method.
Disclaimer
The Service is provided "as is" and "as available" without any express or implied warranties, including those of accuracy, fitness for a particular purpose, or uninterrupted availability.
Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or for any loss of data or profits, arising from your use of the Service.
Termination
- We may suspend or terminate your access if you violate these Terms or use the Service in a way that could cause harm.
- You may stop using the Service at any time.
Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the updated Terms.
